Authentication system with faicel recognition is justified and adequate to achieve the objective. The French highest administrative court dismissed a request by an association for citizens' digital rights to rescind a decree allowing the operation of a biometric app to authenticate access to public services. The court ruled that consent can be freely given since there are others means external to the app to allow authentication for the service. Moreover, it considers the sensitive data collection necessary and proportionate to the purpose since there are no other means that provide the same identification certainty. The court declined to refer the questions to the CJEU for a preliminary ruling.
