Hague Court of appeals ordered this week that a church in Dordrecht must hand over to its church member every document that contains personal data about him. Organizations can not simply reject a data subject access request because it concerns confidential or internal notes.
A member of the church in Dordrecht asked the church council in December 2017 to hand over documents that reveal her sensitive information. The woman, relying on the right of access under data protection law, requested the documents after she had ended up in a long-standing conflict with the church board in the previous years.
The Court of appeals decided against a previous decision of the Rotterdam District Court. The Court ruled that a data subject has a right to receive a copy of Internal confidential documents that contains his personal details. It does not matter whether this is objective or subjective information, for example, in the form of opinions or judgments, provided that this information concerns the person concerned. The church may restrict access to the document section which reveals third party information, for example, by anonymizing who said what about the church member in question.

בית המשפט הכריע בערעור נגד החלטה קודמת של בית המשפט המחוזי ברוטרדם וקבע כי בהתאם לרגולציית הגנת המידע (GDPR) עומדת לנושא המידע זכות לקבל עותק של כל מסמך הכולל פרטים אישיים אודותיו. אין זה משנה אם המידע אודותיו המופיע במסמך הוא אובייקטיבי או סובייקטיבי, כגון דעות או הערכות. עם זאת, הכנסייה יכולה להגביל גישה ולהתמים את החלק במסמך החושף מידע על צד שלישי, לדוגמה מי אמר מה לגבי חבר הכנסייה.
